Individual Student Incident

  • Conviction of an alcohol /drug violation (other than DUI) of Virginia State Alcohol/Drug Laws in the city of Lexington/Rockbridge County
  • Violation of the University residential alcohol/drug policies
  • Misconduct that violates University alcohol/drug policies
  • Drunkenness, when it results in behavior that draws attention to or endangers self or others
  • Students who are deemed an “accessory” to violations may be held accountable for “conduct unbecoming to a W&L student”

Possible Sanctions

DUI: The SJC may suspend or dismiss a student for driving under the influence in Lexington/ Rockbridge County. There is a presumption of suspension with a BAC above .15 or “refusal” to take a BAC test at arrest.

DUI under age 21 with a BAC of .08 or greater carries a recommended sanction of suspension.

First Incident: Handled administratively (drug distribution handled on a case-by-case basis)

  • Written warning 
  • Educational assessment
  • Period of probation from date of incident

Second Incident: Within 1 year of the 1st incident

  • Administrative Hearing or referral to the SJC
  • Educational assessment
  • Conduct Probation
  • Community Service
  • Parent/legal guardian notified

Third Incident: Within 1 year of the 2nd incident

  • Referral to the SJC
  • Educational assessment for those not dismissed; sanction up to and including dismissal
  • Parent/legal guardian notified

Student Organization Incident

Violations of University policy by any student organizations not under the authority of the Interfraternity Council (IFC) are handled by Student Judicial Council (SJC). The IFC handles violations of university policy for all fraternities under their authority.

"Safe Haven:” Seeking medical care for an intoxicated student will not result in disciplinary action. Parents will not be notified unless there is significant danger of serious harm to self or others.

Possible Sanctions

  • A monetary fine.
  • The payment of restitution for property damage.
  • Specific task(s) related to the nature of the misconduct.
  • Educational programming.
  • Community service on or off campus.
  • Removal from University housing.
  • Limitations or cessation of the recruitment and/or initiation of new members.
  • Conduct Probation - a formal warning that additional misconduct may result in more severe penalties. Length varies.
  • Suspension – length varies. Suspension results in separation from the University roles and if an individual or organization desires to return, they must apply for and be readmitted or reinstated consistent with university procedures.
  • Dismissal from the University and ineligibility to apply for readmission.

Hazing violates both University policy and Commonwealth of Virginia law. All cases of hazing are handled by the appropriate judicial body on a case-by-case basis. Learn more about hazing prevention, education, and reporting on the .

NOTE: This policy includes the use of illegal drugs. Conviction of possession/use of illegal drugs within any residence hall may result in removal from the residence hall without refund.
